The Trump administration has spent the entirety of this term attacking our system of checks and balances – trying to erode any structures that would keep them from carrying out their unconstitutional attacks on our civil rights and liberties. And their chief target has been the judiciary.

Fair and impartial courts play a critical role in upholding our freedoms and reining in overreach from any other branches of government. One essential tool our nation's judges have to prevent immense harm while cases go through the courts is to temporarily block unlawful policies by issuing injunctive relief or temporary restraining orders. Without this, the government could continue to violate our rights for years while awaiting a final court decision. Yet extreme lawmakers are trying to roll back the power of judges to issue preliminary injunctions or temporary restraining orders – and hiding their attacks in unrelated budget bills.

Attacks on our courts pose a danger to us all – and would remove a check on the executive, threatening every right we hold dear. Tell your representatives: Protect our courts.

As your constituent, I’m writing to urge you to vote no on any bill attacking checks and balances – including the budget reconciliation bill if it includes Senator Grassley’s latest addition forbidding judges from issuing preliminary injunctions (PI’s) or temporary restraining orders (TRO’s) if the plaintiff doesn’t pay a large bond. These attacks pose a direct and immediate danger to all of us – and threaten the very checks and balances that our rights depend on.

Stripping away the courts’ power to issue PIs or TROs would undermine the courts’ constitutionally protected power to serve as a check on unlawful executive power and would open the door to untold civil rights abuses from the executive branch.

PIs and TROs are an essential part of protecting our rights while the courts do their jobs, and taking away this power would be a disaster for our rights and for our democracy. No president should be above the law. Please, vote no on any bill attacking our judiciary and do everything in your power to protect our courts.
