The right to protest is a protected freedom, but it also comes with the reality that some may see speech they disagree with.

But threatening Wyomingites with felony charges for exercising their right to protest is a clear attempt to persuade them to remain silent and thus, chill their constitutionally protected right to assemble and speak.

That is why the ACLU of Wyoming opposes Senate File 87. This bill attempts to impose felony-level criminal penalties for unintentional conduct that may arise while a person is engaging in constitutionally protected speech that some may find distasteful. Such government retribution will chill protected speech in violation of the First Amendment and unnecessarily enshrine harsh, unnecessary criminal consequences in state law.
