We all have the right to expect that when government officials violate our constitutional rights, there will be accountability and remedies for the harms they have caused. H.849 represents one of the most meaningful opportunities we have as a state to protect the people of Vermont from the types of lawless and unconstitutional actions we have seen in places like Minnesota, Chicago, Portland and Los Angeles.
Currently, federal law allows people to sue state and local officials for constitutional violations, but only allows for lawsuits against federal agents in very limited circumstances. Luckily, states can address this by passing legislation that will allow people to bring lawsuits if any government official, including federal officials, violates their constitutional rights. To that end, we are calling on the Vermont legislature to pass H.849, the Constitutional Accountability Act.
By passing H.849, we can make sure all government officials are accountable to upholding the Constitution, because no one in our country is above the law. The good news is this bill has already been voted out of the House Judiciary Committee and is headed to a vote in the full House of Representatives. If the bill passes the House, it will then head to the Senate for further consideration.
We hope you will take a minute to send the message below to your representative(s) in the State House and ask them to vote yes on H.849 when it comes to the House floor.
