Protect Abortion in the Constitution

The Supreme Court of the United States has overturned Roe v. Wade. While abortion is still legal in New York, our state's constitution does not protect pregnant people if they have an abortion, suffer a miscarriage or stillbirth, or give birth to babies who do not survive. We need to codify protections into our state constitution to insulate our abortion rights from any future meddling or shifting political winds.

TAKE ACTION: Tell Governor Hochul to ensure this amendment passes in a special session immediately.

While abortion is well protected under state laws, our state's constitution does not protect New Yorkers if they have an abortion, suffer a miscarriage or stillbirth, or give birth to babies who do not survive.

With the Supreme Court's decision to overturn Roe v. Wade and the protections it provides, we must protect abortion in our state constitution.

You must ensure the passage of a constitutional amendment that bars discrimination based on a person's race, national origin, disability, sex — including pregnancy and pregnancy outcomes, sexual orientation, gender identity and expression. A strong equality amendment must go beyond prohibiting only acts of intentional discrimination and include policies that have a discriminatory effect.

The equality amendment must be passed during this week's special legislative session to start the three year process of putting Roe on the ballot in New York in 2024.

If lawmakers do not pass a bill (S.8797B/A.10468A) calling for a constitutional amendment this year, it will not go before voters for ratification until at least 2026.
