Oregon lawmakers are considering a bill, HB 4126, that could create tougher sentences for individuals wearing a mask at a protest that is deemed a “riot.” But police can arbitrarily, and without notice to the crowd, classify a protest as a “riot” based on isolated actions of a few.
Under the proposed law, peaceful protesters could find themselves facing criminal charges and tougher sentencing based on the fact that they are wearing a mask—even a bandana designed to protect against tear gas; a mask that parodies a public figure; a religious face covering; or a mask to stop the spread of germs.
A policy that effectively prohibits wearing a mask to a protest risks chilling First Amendment-protected activities, particularly for those who wear 'masks' for political and religious reasons.
We already have laws to punish people who commit crimes. The policy is unnecessary.
