A new bill, called the No Kings Act, or SB26-176, would allow Coloradans the ability to sue a government official, including federal officials and federal law enforcement, for violating the rights guaranteed to them in the U.S. Constitution.

Currently, federal law only allows for state and local government officials to be sued for constitutional violations, which prevents clear accountability for federal government officials and agents who infringe on constitutional rights. The No Kings Act opens the courthouse doors and closes this accountability gap.

The bill now heads to the Senate Judiciary Committee. Committee members are set to meet soon to vote on this critical piece of legislation. We're calling on you to contact committee members and urge them to pass the No Kings Act.

I’m writing to urge you to vote YES on SB26-176, the No Kings Act. This bill opens the courthouse doors to Coloradans whose constitutional rights have been violated by a government official, including federal officials, and makes clear that no one is above the U.S. Constitution. While federal law already allows lawsuits against state and local officials who violate the Constitution, federal officials currently face no consequences. The No Kings Act restores a basic promise: if your rights are violated, you can seek justice in court.

Importantly, the No Kings Act does not impose any new requirements on state or local officials or change their scope of potential liability. This bill simply expands the type of defendant a person in Colorado can sue for constitutional violations to include federal officials while maintaining the status quo for liability for state and local officials.

None of us are safe when the government can harm people without consequence. The No Kings Act restores accountability, can deter abuse, and protects every community from unchecked government harm. As federal agents are increasingly deployed to our communities, it is critical to ensure they cannot violate the rights of Coloradans without accountability. We need lawmakers like you to uphold those constitutional safeguards and vote YES on SB26-176.
