The Immigrant Safety Act (HB 9) would end New Mexico’s involvement in ICE’s corrupt detention system, which relies on local governments to bypass oversight and shield private contractors from accountability. By closing these loopholes, HB 9 ensures that our state is no longer complicit in documented human rights violations occurring in ICE detention centers. Seven other states—including Colorado, California, and Washington—have already taken this step to protect their residents. Now, it’s time for New Mexico to do the same.

I am reaching out to request your support for HB 9, the Immigrant Safety Act. This critical legislation aims to stop local governments from entering or renewing contracts with Immigration and Customs Enforcement (ICE) for civil immigration detention.

In our state, there are currently three ICE immigration detention facilities with a capacity to detain over 2000 individuals. To do this, ICE exploits New Mexican counties as pass-throughs for no-bid contracts with private detention operators to avoid scrutiny of their poor safety records. The three ICE facilities operating under this scheme continue to subject people in immigration detention to inhumane conditions. There are alarming reports of medical neglect, inappropriate use of solitary confinement, suicide attempts, and deaths. These problems continue to exist despite various inspections and oversight measures.

While New Mexico cannot directly regulate ICE, we can refuse to be complicit in enabling a system that violates human rights and due process. With expanded immigration enforcement planned, ICE is more likely to conduct arrests and raids near existing detention facilities, so reducing detention capacity here will make our immigrant communities safer. Getting New Mexico out of the business of immigration detention makes everyone safer, especially by reassuring immigrants that they can reach out to local officials when they need help.

HB 9 will close a dangerous loophole to transparency and good governance in detention contracts, and demonstrate strong support and dignity for immigrants in New Mexico. Please vote to pass this critical bill.
