With just hours to spare in the 2026 legislative session, the Maryland General Assembly passed SB 791, the Community Trust Act.
SB 791 limits how law enforcement can informally partner with Immigration and Customs Enforcement (ICE), helping protect people who have not been convicted of a crime from notification or transfer to ICE without a court order or judicial warrant. The bill also bans the unconstitutional practice of detaining people beyond their release date from local correctional facilities for immigration enforcement purposes without a judicial warrant.
The passage of SB 791 is the result of years of work by the ACLU of Maryland, We Are CASA, and impacted people and advocates from around the state. As passed, SB 791 significantly limits Maryland's cooperation with ICE, bringing Maryland a step closer towards ensuring all people, regardless of immigration status, can live and work freely in our state without fear.
As emergency legislation, the bill will go into effect upon the Governor's signature. Now, we must urge Governor Moore to sign this legislation as soon as possible.
