SB 76 would steer Indiana in the wrong direction by creating real harm for everyday Hoosiers, not just immigration policy on paper. This bill would increase the risk of wrongful detention, burden local governments and colleges with more state mandates on top of existing immigration requirements, and create new workplace pressures that could block legal workers from jobs and disrupt large state employers.

This bill pushes local agencies to treat ICE detainer requests like mandatory holds. When they're wrong, incomplete, or delayed, innocent people can end up incarcerated longer than they should be, even when they can show a U.S. birth certificate or passport. That's a due process issue and an unnecessary liability for local governments. The bill also overrides local decision-making and pulls public colleges into immigration enforcement dynamics, regardless of what is actually needed to keep campuses and communities safe and thriving.

The bill's workplace enforcement language and broader reliance on error-prone E-Verify would also have an adverse impact on Hoosier jobs. When verification errors happen, legal workers can lose opportunities or paychecks while trying to correct information, and employers, especially small Indiana businesses, could face staffing disruptions and increased compliance burdens. It also increases the risk of discriminatory hiring practices when businesses feel pressured to avoid eligible workers who they believe might prompt paperwork complications.

Indiana can support public safety for all Hoosiers without creating unfunded burdens on cities and counties that target immigrants, wrongful detention risks, and job barriers for legal workers.
