Jails and prisons are some of the most dangerous places to be during this pandemic just like nursing homes and other congregate settings. We have been asking for action since March. There are options to avoid continuing the tragedy we find ourselves in now:

1. Release people with medical conditions to home confinement and reducing our jail and prison populations to allow social distancing, without waiting for further court orders to do so.

2. Start using clemency power for compassionate release to let out kupuna, medically vulnerable people, people with little time left on their sentences, people convicted only of drug possession, people incarcerated for technical probation or parole violations, and people being held simply because they cannot afford to pay bail.

3. Issue clemency for people who – if convicted under current laws – would serve a lesser sentence than what they are currently serving.

4. At a minimum, make sure incarcerated people with underlying conditions that put them at significantly higher risk get the vaccine at Stage 1b, since they would qualify.
