Stand up for Second Chances in Delaware

We believe more Delawareans should be able to move beyond their records and receive a true second chance at economic success and inclusion in their communities, and for the past several years, we’ve been making significant headway toward making that dream a reality — but there’s one big barrier: the expungement process is hard to navigate, costly, and time-consuming.

There are 290,000 people with records in Delaware who would be eligible for expungement under Clean Slate laws. A true second chance is within their reach. Even if every person who had a record could afford to go through the expungement process, as our current system operates, it would take nearly 200 years to process all those expungements because we rely so heavily on administrative labor to complete the process. SB 111 and SB 112 will address these issues.

SB 111, the Automatic Expungement bill, would create an automated expungement process for adult and juvenile records that are eligible for mandatory expungement.

SB 112 w/ SA 1, the Mandatory Expungement Expansion bill, would expand eligibility for mandatory expungement of adult and juvenile records so that more records would qualify for automatic expungement under SB 111.

These bills aren’t just good for Delawareans living with records. They’ll help boost our economy by expanding the workforce and giving people a better shot at a stable income, and they’ll help keep Delawareans safe by promoting healthy communities through lower poverty, recidivism, and crime rates. Everyone stands to win with Clean Slate legislation in Delaware.
