Tennessee lawmakers are taking up SB 2223/HB 2219, which would mandate all Tennessee counties to enter 287(g) agreements, contracts that require them to collaborate with ICE on immigration enforcement. The bill penalizes those that fail to comply by withholding tax revenues and state grants. 287(g) agreements would make it easier for ICE to work with local police and sheriff departments, using our local taxpayer dollars and resources to support federal deportation efforts. The dangers of SB 2223/HB 2219 are clear. Provisions of this bill include:

  • Erosion of local control: This bill limits the ability of cities and counties to set policies that reflect the needs of their communities, as law enforcement 287(g) agreements are not subject to local government approval. Forcing local law enforcement to act as federal immigration agents requires officers to interpret and enforce complex federal laws outside their training and typical responsibilities.
  • Undermining community trust and safety: Studies of the 287(g) program have long shown that it undermines public safety by decreasing trust in local law enforcement and diverting resources away from investigation of serious crimes. Many law enforcement leaders have joined civil rights groups in calling for its termination.
  • Misuse of taxpayer dollars: Taxpayer dollars are better spent investing in programs that actually keep our communities safe – not fueling the Trump administration's plans to deport immigrants who contribute to our communities and our economy.
