Abortion is already banned in our state. SB 236 is an unnecessary escalation of this ban.

The bill targets medication abortion by deputizing private individuals to enforce the ban through civil actions, creating a bounty-style enforcement system that includes both wrongful-death and qui-tam lawsuits. It provides a 20-year window for these lawsuits and paves the way for incredibly severe damages and fees, including $100,000 per violation. The promise of financial rewards incentivizes people to surveil their fellow Hoosiers and provides a pathway for abusers and estranged partners to harass women.

The provisions that shield this new chapter from legal challenges also set a dangerous precedent that avoids fairness and basic accountability – this should concern all Indiana residents; it weakens public trust in the law.

This bill also expands government intrusion into private medical decisions by empowering the attorney general to sue on behalf of a fetus and by allowing the inspector general to access sensitive medical records and terminated pregnancy reports. This kind of enforcement invites surveillance and intimidation and will chill patients from seeking potentially life-saving care.
