DOD045898-DOD045903 Record of claims under Foreign Claims Act and Military Claims Act     Forms and correspondence regarding claims of persons under the Foreign Claims Act for torts suffered at the hands of U.S. authorities. Includes claims for torture. Claim of Canadian citizen (BATES 310-317) born in Egypt for compensation for torture and other injuries inflicted on him when he was captured and held in Camp Bucca, Iraq in 2003. The claimant is a member of a peace organization called "Rights and Freedom International." He was in Iraq on a mission to convince the Iraqi leaders to step down in order to avoid a war. He was tortured for three weeks. The torture included beatings, withholding of medicines and medical treatment, having interrogators put the muzzle of a gun to his head, witnessing other detainees being beaten, solitary confinement, being hogtied for hours, being kept under the hot sun, uncomfortabe positions for extended periods, and threats that he would be sent to Guantanamo if he complained about the beatings. The detainee went on a hunger strike after which he was beaten by a female officer. He was then deported to Egypt

DOD045906-DOD045923 Record of claims under Foreign Claims Act and Military Claims Act     Claimant is Iraqi of Swedish citizenship arrested in Baghdad in September 2003. Was imprisoned for 8 days in El-Najaf, then for two days in Dewaniya and then taken to Abu Ghraib. He was subjected to many forms of torture, beatings, assaults, sexual humiliation, threats and "unspeakable and demoralizing acts." In one instance, the claimant and 12 other naked prisoners were roped together by the genitals while a laughing guard pushed one of the detainees on the ground, causing other detainees to suffer. He was shocked with an electric stick, kept awake with loud music, had a belt tied around his neck and was dragged approximately 70 feet. A dog was used to intimidate him. In another instance, an American guard shot randomly at the crowd, killing approximately five prisoners. Letter at 293 - 297 details other instances of abuse. A reply from the Army Claims Service acknowledges receipt of the claim, asks for more information and states "The MCA [Military Claims Act] requires that the alleged Government tortfeasors be acting within the scope of their authority when they cause injury to a claimant. Some of the conduct you allege occurred appears to be clearly outside the scope of duty required of a military member to arrest and detain someone. Please explain why you believe that this conduct falls within the coverage of the MCA." (301).
DOD045924-DOD045944 Record of claims under Foreign Claims Act and Military Claims Act     Canadian citizen and permanent resident of the United States makes claim for compensation for torture and other mistreatment following his arrest in Baghdad on April 9, 2003. The claimant is a member of a peace organization called "Rights and Freedom International" (RFI) and was in Iraq on a mission to convince the leaders of Iraq to step down and avoid a war with the United States. He was held at Camp Bucca where he was tortured and beaten on a daily basis. Interrogators put gun muzzles at his head or body, putting him in great fear of imminent death.  His medication for glaucoma and depression were withheld.  He was threatened with going to Guantanamo if he complained about the beatings.  After three weeks of torture, the detainee went on a hunger strike in an effort to stop the torture. He was then beaten and taken to solitary confinement.  On one occasion, a Major suggested that the detainee complain about the beatings to the Criminal Investigation Division (CID).  After the detainee wrote a complaint to the CID, other soldiers beat him for submitting the complaint.  Detainee was then deported to Egypt.  A reply letter from the Army Claims Services states "The MCA [Military Claims Act] requires that the alleged Government tortfeasors be acting within the scope of their authority when they cause injury to a claimant.  Some of the conduct you allege occurred appears to be clearly outside the scope of duty required of a military member to arrest and detain someone. Please explain why you believe that this conduct falls within the coverage of the MCA."
DOD045945-DOD045962 Record of claims under Foreign Claims Act and Military Claims Act     Claimant was a night patrol guard in the village of Annana.  On July 16, 2003, U.S. Marines attacked the village and claimant was shot 6 times. [I haven't heard of an attack on this village - the witnesses say this village of off-limits to American soldiers and they were not supposed to attack it.] He was taken to the hospital and later to Abu Ghraib.  The Combined Joint Task Force offers the person who was shot $1,000 to settle, stating in a letter to his mother that "it appears US forces were negligent in shooting your son.  In addition, he should have been released from the hospital and instead was arrested and transported to Abu Ghareb prison."  Payment was approved and made to claimant to settle claim.
DOD045963-DOD045968 Record of claims under Foreign Claims Act and Military Claims Act     Claim by family of a detainee who died in U.S. custody.  Detainee was arrested in May 2003 and imprisoned at Abu Ghraib. Testimony shows that family was told by detainees who were released that the detainee had died in prison.  The family went to the hospital where they were able to see the corpse.  He was inside a black bag, wearing a red suit and his hands were tied.  There was a blue spot on the eye.  At the hospital, the family was told that Americans  had left the body at the front gate of the hospital.
DOD045969-DOD045971 Record of claims under Foreign Claims Act and Military Claims Act     Claim by family of a, Iraqi chemist who was tortured and died in U.S. custody. He was arrested on April 25, 2003.  On November 11, 2004, the family was allowed to visit him at Baghdad International Airport (BIAP) and his health was good at the time.  The family was told on Feb. 17, 2004 by the Red Cross that the father (detainee) had died on January 31, 2004 as a result of being tortured and that, according to American reports, there were bruises on his face, wounds and signs of surgery on his head.  The family was able to see the corpse at Kerh hospital where they observed an injury on his head and a scratch on his face.

Investigations by the Army suggested that the chain of command failed to appropriately train the unit for a peacekeeping mission, exceeded their authority in aggressively favoring one faction over another, and tolerated misconduct by members of the unit. .. Detainee abuse in Iraq and Afghanistan echoes the incident reported in Kosovo ... This begs the question, however, about how the Army may have used the lessons of Kosovo and will use the lessons of Iraq and Afghanistan to better prepare leaders and soldiers for the realities of military operations today and tomorrow." Detainee stated that SGT [Redacted] hung him by his arms from the bars of the metal door for two hours, while a female soldier threw cold water on him. Another detainee said he was beaten while in custody, and that this resulted in broken ribs and a broken hand. He was put in a shower and stripped while female soldiers looked at hime and one blew smoke in his face. She moved his hands and would not let him conceal his genitals. (DOD043786). A female soldier testified that she observed detainees' showers and she would "laugh at them, point at the detainee's penis, make fun and laugh at them." (DOD048866). A detainee said he was placed under a cold shower for 10-15 minutes on several days, that a soldier burned him with his cigarette and that somebody turned on a "noisy recorder" all night. (DOD048730). Soldier said in sworn statement that it was common to use fake names when interrogating detainees. (DOD048766). False names and rank are Standard Operating Procedure and are part of instructions. (DOD048766). Investigation concluded that offenses did not occur as alleged based on lack of medical documentation, inability to determine if a scar was the result of a cigarette burn and based on a statement by a soldier that the victim was "like a hypochondriac." (DOD048709).

(DOD048970). An email dates May 3, 2004 states, "It's too early to call to tell what effect the recent media firestorm will have on these cases. .. DOD049084 Military Justice Field Records   6/3/2004 In December 2002, at Bagram Detention Facility, 2 Afghan detainees
died while in the custody and control of US forces, specifically members of the 3771h MP Co and an active duty MI Company, A Co, 519th MI Bn. The deaths were determined to be a result of blunt force trauma by
various members of the 377th and 519th. Investigation continues by CID; FORSCOM SJA has the lead on these cases. Relates to document at DOD048929-DOD049083.
DOD049085-DOD049088 Executive Summary: Army Reserve 377th MP .Company Soldiers - Pending UCMJ prosecutions Investigations     Attachment of email at DOD048929-DOD049083. Background: Two PUCs (Persons Under Control) died in December 2002 at Bagram Airfield
Containment Facility. US Army Criminal Investigation Command (CID) is pursuing investigations concerning these deaths as well as the use of force against other PUCs. A U.S. military autopsy listed "homicide" as the cause of the two deaths. Soldiers were administratively "flagged" and Court-martial charges were preferred on 20 March 04 against six Army Reserve MP Soldiers. The charges include: (1) indecent acts for ordering detainees to publicly masturbate; (2) maltreatment of
subordinates for non-physical abuse for ordering detainees into nude pyramids and taking pictures of the nude detainees; (3) battery for shoving and stepping on detainees; (4) dereliction of duty; and (5) conspiracy to maltreat subordinates. Two NCOs were also charged with aggravated assault for striking detainees with enough force to cause serious injury. One Soldier was charged with desecrating a corpse by taking photos of two dead bodies. Report states that there is "No connection between these corpse photos and the crimes committed against the detainees at BCCF [Abu Ghraib]." CJTF-7 sent a seventh Soldier pending charges, PFC- to an MP unit at Fort Bragg because she was pregnant. DOD050432 Army Criminal Investigation Command Report of Investigation Number 0114-04-CID259-80207-51HA 5/21/2004 12/12/2004 A video captured what appears to have been a killing of an injured man. "The UAV (unmarined aerial video) tape showed a black sedan crashed into a wall, with a wounded man lying on the ground by the driver side of the car. The wounded man was moving his right arm and one of his legs. As the UAV moved around the car, you saw a soldier searching the car, and a soldier standing on the driver side to the rear of the vehicle. The soldier standing on the driver side of the vehicle then fired what appeared to be one shot in the direction of the wounded man. A few seconds later a second shot appeared to have been fired and a third shot 15 to 30 seconds after that. When the UAV moved back around to the driver side of the black sedan, the wounded man is no longer moving and a substantial amount of blood, and what appeared to be brain matter was spilled out onto the ground, blood and brain matter not previously there." Interviews of possible interrogators did not reveal any evidence of Assault nor did they prove the Assault did not occur as alleged. However, medical documentation revealed the detainees complained of sore joints and muscle soreness during their initial medical screening at the BCCF, Abu Ghraib, IZ, but showed no other evidence of abuse. Some detainees complained of beatings and other abuse. Soldier/officer states that detainee's eyes are taped shut as a measure to keep them from knowing the layout of the facility and that they are put in stress positions for up to one hour. DOD052120-DOD052349 Army Criminal Investigation Command Report of Investigation Number 0139-2004-CID259-80203 04/27/2004-05/25/2004   Detainee alleged being kicked and punched, shocked with a tazer, and threatened at knifepoint at Kheriolla House. Detainee said his face was covered with plaster until he almost suffocated. Medic examined detainee to determine if he was fit to undergo interrogation. Medical exam showed scar consistent with knife wound and scars consistent with electric shock injuries. Medic sat Abu Ghraib stated that the injuries were consistent with the detainee's allegations: "Everything he described he had on his body." Yet, the medic determined that he was fit for interrogation. All counts of aggravated assault, maltreatment and cruelty are unfounded. Claims were unsubstantiated due to a lack of evidence. While in custody, he was beaten and remembers loud disco -type music A soldier's sworn statement confirms that while stopped on the side of the road with detainees, a car of interrogators from the 1-8 Cavalry drove up and started beating the detainees, then took them one by one to a concrete block shed, beat them and asked them about a kidnapped girl. Another soldier confirms that interrogators had "Titan" badges and one of them said that the detainees had killed his wife's father and kidnapped his sister. (DOD053296). A detainee alleged that he had been burned with "hot gases" coming from a transport vehicle while he lay on his stomach in the back of the vehicle. Medical records revealed that injuries were consistent with allegations. Medical treatment required several skin grafts and partial amputation of one thumb and part of his leg. Two categories are described. First, acts that are "clearly crimiinal in nature", including assaults and requiring detainees to simulate sexual acts. These cases "subject the perpetrator to criminal liability and subject those in the supervisory chain of command who knew of the misconduct and approved or condoned it to criminal liability also." The second category is a set of cases that have more complex facts. It is unclear if these acts constitute "maltreatment" under Article 93 of the UCMJ and the culpability of higher-ups is unclear. These acts include use of military dogs to envoke fear, stress positions, nudity, putting women's underwear on detainees' heads and faces while cuffed and unable to remove them. Legal discussion point out that Article 93 does not specifically prohibit these acts, but does prohibit cruel, inhumane or degrading treatment and intent must be determined. In order to find a violation of Article 93, it requires a probable cause determination that the accused was cruel toward, orppressed, or maltreated a person subject to the accused's orders.

Subject: Knowledge of incidents relating to Iraq Prison situation   5/19/2004 Officer in charge of a 3-4 man team of interrogators stated that there was a 35-page “Frag Order” (Fragmentary Order) spelling out the rules of engagement that interrogators were supposed to follow, and that they were encouraged to “go to the limits to get information from the detainees by people who wanted the information.” When asked to whom the officer was referring, the officer answered “LTG Sanchez.” The officer stated that the expectation coming from “Headquarters” was to break the detainees.
