DOD043457-DOD043524 CID Report of Investigation. 0074-2004-CID342-64146   11/4/2004 Investigation based on civilian (former military) person's allegation that he witnessed U.S. Service members abusing Iraqi detainees. Investigation did not develop sufficient evidence to prove or disprove the allegation. Sworn statement where person says he saw Marines place bags over prisoners' heads and strike them in the head with pick axes' handles in an effort to obatin information. (DOD043462). When he reported the incident to Marine MAJ he was informed the Marines were doing their job by getting guns off the street that were meant to kill US service members. (DOD043462). He witnessed Marines repeatedly pouring peroxide and water over the open wounds of an Iraqi prisoner and witnessed soldiers from the 372nd MP CO. use slingshots against Iraqi children who were attempting to steal food from the base, as well as other accounts of abuse from that MP CO. (DOD048462). Member of 372nd MP CO. states that on a mission in Iraq a vehicle cut off the HMMVE. "CPL [Redacted] and SSG [ Redacted] pulled the driver out of the car at shotgun point and told him how bad he was for cutting off an American vehicle. SSG[Redacted] had the shotgun in the Iraqi's mouth and CPL [Redacted] had his M4 to the individual's head." DOD043463. Sworn statement: person saw Iraqi police officers beating the feet of an inmate who was accused of rape. DOD043466. Sworn statement: person witnessed U.S. Marines strike a detainee in the head with an axe handle while in Al Hilla, Iraq. (DOD043470).

Subject: Detainee Abuse by Taskforce Ironhorse Soldiers as Reported to CJTF-7 9/8/2003 5/12/2004 On 09/08/03, an Iraqi man was detained and alleges he was blindfolded and taken to a jail cell in Northern Tikrit where American soldiers in civilian dress and an Iraqi interpreter hit him repeatedly for two hours. At one point a rope was put around his neck and he was choked almost to the point of passing out. (DOD043553). On 9/11/03, SPC [Redacted] was performing guard duty at FOB Packhorse. A detainee held in isolation in flexi cuffs moved toward the concertina wire. SPC [redacted] fired his weapon stating that he saw the detainee with his hands near the wire. Detainee died of gunshot. SPC had no specialized training in handling detainees. (DOD043553). On 06/13/03, two PFCs, through simple negligence, discharged a 9mm pistol in the B CO., 3-67 AR BN detainee holding facility. The round struck an Iraqi civilian wounding him in the lower back. No UCMJ action was taken. (DOD043553-4). Detainee who was apprehended on 11/22/03 sustained injuries: PFC [Redacted] struck him in the back of the head and PFC [Redacted] kicked him in the back of the head. Both PFCs received field grade Article 15 punishment. (DOD043354). On 08/20/03, soldiers punched detainee with closed fist in the stomach, torso and side of head when he was not forthcoming with information during interrogation. When interrogation did not reveal the information the group was seeking, LTC [Redacted] took the detainee outside to the nearest clearing barrel and after shooting a warning shot, placed his 9mm weapon near the detainee's head and fired off a round. (DOD043354). (Same investigation as DODDOACID 009374-009375). On or about 10/15/03: soldiers noticed detainee trying to escape. Allegation that three soldiers threw a bottle of water and hit detainee with a hat rack, once in the stomach. Inquiry found that force was excessive. (DOD043555). On 09/24/03 SPC [Redacted], a trained interrogator with 104th MIB, DISCOM at FOB Ironhorse hit bottom of detainee's feet, back and buttocks with MP baton. (DOD043555). 08/02/03: SSG pointed a pistol at detainee, punched detainee several times in the stomach, head, face and nose. Detainee had a cut over his eye that required stitches and a broken nose. Soldier was granted Chapter 10 request. SGT who was present and also hit the detainee received field grade Article 15 punishment. (DOD043555). 02/7 - 02/8/04: A 61 year old detainee died while at Detention Central Facility FOB Ironhorse. Investigation at DODDOACID-7206-7233. (DOD043556). Case of Muhamad Husain Kadir. CID investigation at DODDOACID005399-DODDOACID005486. (DOD034556). 01/03/04: two male Iraqis were apprehended because they were out after curfew. They were ziptied, put in a Bradley fighting vehicle and driven to a nearby bridge over Tigris river. Platoon leader 1LT [Redacted] instructed members of platoon to push detainees into the river. One member refused. Two members removed zip ties and pushed detainees into river. One detainee drowned because he could not swim. Chain of command instructed platoon members to deny any wrongdoing. DOD043575-DOD043580 Report by AR 15-6 Investigating Officer on Shooting Death of Iraqi Detainee, FOB Packhorse, Tikrit, Iraq, 11 Sep 03     Investigation into incident where SPC [Redacted] who was guarding section, shot and killed a detainee who was cuffed in isolation at FOB Ironhorse on 9/11/03. Medics had advised guards that detainees in isolation could get up and walk around in order to relieve discomfort and muscle and joint pain. SPC said he saw detainee touching concertina wire. He did not give any verbal warning. SPC was described as overly agressive and on occasion vulgar to the detainees. Findings: SPC was in violation. There are insufficient instructions for guards in performing their duties. There are no written SOPs or post instructions for guards. The combination of loaded weapons within the confines of the detention facility and the inadequate number of guards are conducive to quick escalation of use of deadly force. (DOD043618). 01/28/02: "We arranged with day shift MP's to keep detainee #[redacted] in JIF booth number 1 on sleep dep beginning 271507ZJAN02. 02/01/01: Officers question detainee and notice multiple cuts, bruises and abrasions on detainee's face; detainee complains of severe headache and sore ribs. (DOD043619-20). 02/01/02: During interrogation, MP did not loosen detainee's ankle cuffs when asked to do so, stating they were not tight. When asked again, SPC used unnecessary force, pulling detainee's feet out from under him by the ankle chains, stepping on his thigh while loosening the cuffs, then kicking him in the feet when finished. Later, the MP NCOIC SSG barged into the booth demanding to know the problem. Detainee asked not to make a fuss over his treatment for fear of further mistreatment. (DOD043620) 02/04/02: Detainee states that whe he was praying the guards asked him a question and when he did not answer, because he was praying, he was punished with physical training. (DOD043620) Medic is unresponsive to detainees' needs and appears callous. DOD043620. Great deal of disorganization in moving detainees from cells to interrogation rooms.
DOD043622-DOD043623 Sworn statement of interrogator, Task Force 202 Military Intelligence Battalion 1/2/2002   On 01/02/02 noticed detainee in joint interrogation facility with cuts and bruises and complaining of pain and soreness. Detainee stated that he was beaten by three or four guards. Everybody in pen was instructed to get up and when he couldn't because of numbness in the legs, guards began to beat him. Declarant had spoken to detainee about a week prior and had not noticed visible marks on his face at the time. "It is quite apparent that between my initial meet and 01FEB02 meet that something had happened to MP number [Redacted]'s face.

During a medical exam, instead of a medical personnel, one of the MPs conducted an anal probe on detainee. "He was a large man. Without warning the EPW [Enemy Prisoner of War], and in a cruel way he pushed both his fingers into the EPW's anus. This caused the EPW to scream and fall to the ground violently. His leg irons, which I supposed were not locked, came open by force of his reaction."

DOD043632-DOD-043633 Sworn statement of U.S. personnel in Task Force 202 Military Intelligence. 2/1/2002   Detainee's face was cut and swollen in several places consistent with repeated blows to the face. Detainee stated that guards had asked everybody to stand and when he couldn't because his leg was numb, he was kicked in the head and face by the guards. DOD043634-DOD-043635 Sworn statement of interrogator 2/14/2002   Interrogator's sworn statement that he noticed detainee's breathing was heavy and he appeared disoriented. Interrogator asked detainee if he had any health problems. Detainee stated he had been beaten and roughly handled, thrown around by guards. Interrogator terminated interrogation and informed NCOIC [Non-Commissioned Officer in Charge] and OIC [Officer in Charge]. Same incident as DOD043640.
DOD043636-DOD-043637 Sworn Statement of U.S. personnel 01/11/02; 02/3/02; 02/11/02; 02/12/02 2/16/2002 Person doing screening of detainees observed escorts treating a new detainee roughly. When reported to the NCOIC [Non-Commissioned Officer in Charge] of the shift, was told "He told me that our safety and the safety of the MP's [Military Police] was his first concern and that if the detainee is resisting, that certain force is necessary." Person reported the incident to supervisors. While on translator duty with the medic, this person saw detainees who had been beaten. "While explaining to the doctor the situation, a female medic, SPC [Redacted], and a male doctor, CPT [Redacted] both made comments to the effect that they, the detainees, wouldn't hurt if they didn't get hit and to tell them not to get hit again. These two individuals did not want to give pain medicine to these particular detainees." Detainees also complained of dislocated shoulders because of the manner in which they were moved while cuffed. Person reported this to supervisors. Detainee who was trying to escape was treated badly by escorts. His hood was twisted at the nape of the neck until his facial features could be distinguished and his nose squished. He was cuffed and pulled along at a fast rate of speed. When he tripped over a pile of rubbish, his shackle came undone and he was thrown on the floor until his shackle could be fixed. "I did not mention this treatment to higher, as I felt their response would justify the MP's behavior since the detainee was trying to escape, just as we are taught to do." DOD043638-043639 Sworn Statement of interrogator, Task Force 202 1/3/2002 2/13/2002 Translator tells of incident during interrogation. "[We] took a break to regroup … While we were out of the booth, several special forces members entered the booth. … [we] finished the break and went back to continue the interrogation. When we entered the booth, we found the special forces members all crouched around the prisoner. They were blowing cigarette smoke in his face. The prisoner was extremely upset. It took a long time to calm him down and find out what had happened. .. The prisoner was extremely upset. He said that they had hit him told him that he was going to die, blew smoke in his face and had shocked him with some kind of device. He used the term "electricity." Appears to be the same incident as DOD-043628-DOD-043629.
DOD043640 Abuse Complaint by Detainee # [Redacted] 2/14/2002 2/14/2002 Interrogator notices that detainee is having difficulty breathing and seems disoriented. Interrogator asks detainee if he has health problems. Detainee tells interrogator that he has been beaten at detention facility. Detainee states "I am Kuwaiti and have always appreciated the American; they saved our country from Saddam. But, the treatment I have received here is changing my views of Americans." A detainee was handed a shovel and told, at rifle point, to begin digging his own grave. M-4s were fired in his vicinity for intimidation purposes. Punishment: Field Grade Article 15; forfeiture of pay. 2) Detainee was hit in the stomach with a fist after an escape attempt. Punishment: Article 15; reduction in rank, suspended; forfeiture of pay, partially suspended; extra duty for 15 days. 3) After an escape attempt, detainee was struck in the head with a finger, slapped on the face with an open hand, and struck in the body with a bottle of water, all while restrained. Investigation established that there was insufficient evident to prove or disprove listed offenses when he, Mr. [Redacted], struck a detainee across the face during an investigation. Accused was located in Egypt at the time of investigation and attempts to coordinate a trip to question him were unsuccessful, so he was only interviewed through phone and email. Titan interrogator's sworn statement says that when he learned that a linguist had beat an Iraqi detainee while in custody, he informed his superior whose reaction was "Maybe the unit won't report the incident." Interrogator further relates that after reporting the incident, his career took a "nosedive" and that he was fired from his position in An Najaf and Karbala. (DOD0440398-9). Titan interpreter's sworn statement that he saw the accused interpreter open-hand strike a detainee who was sitting on the floor with a sandbag over his head and his hands tied behind his head. Investigators were unable to locate and interview peronnel involved or any medical files relating to detainee. Investigation found there was no probable cause to believe the offenses occurred as alleged; therefore, they are unfounded. A memorandum from CID Assistant Operations Officer to the Commander of CID states that he is unable to thoroughly investigate suspects and witnesses because of their involvement in the Special Access Program (SAP) and/or the security classification of the unit they were assigned to during the offense. (DOD04489). A memorandum states that "An Information Report was provided to this office which stated fake names were used by the 6-26 members. The only names identified by this investigation were determined to be fake names utilized by the capturing soldiers; however, the abuse allegedly occurred during the interrogation of the detainee. The 6-26 CID agent related that the capturing soldiers would not know who the interrogators were. 6-26 also had a major computer malfunction which resulted in them losing 70 percent of their files; therefore they can't find the cases we need to review. This investigation meets the necessary requirements and does not need to be reopened. Hell, even if we reopened it we wouldn't get anymore information than we already have." (DOD044496).

Subject: Report of Alleged Law of War Violation.   8/20/2003 Reports incident in which a 4th Infantry Division (4ID) soldier alleges during Operation Iraqi Freedom that he witnesses the unlawful use of force against non-combatants, theft of private property from Iraqi civilians, and the wrongful dispossession of private and/or enemy property. Unlawful use of force: PFC states that while on patrol, he witnesses Sergeant First Class [Redacted] order soldiers to fire an MK-19 on unarmed civilians (men, women and children). In turn, soldiers directed grenades (from an MK-19) an M-16 fire at civilians. All of the civilians were unarmed and had not engaged in a hostile act or demonstrated a hostile intent although a single shot was heard from an area approximately 90-degrees from the soldiers and 45-degrees from the house. Several civilians were injured. One appeared to have had his arm severed. Maltreatment of detainees: on at least one occasion, unit members placed detainees on the top of a Humvee and between the brush guard and hood and drove the vehicles with the detainees in this position. PFC [Redacted] was also told of soldiers in Section A who severely beat a detainee. Memo recommends forwarding information so a prompt investigation can be conducted.

DOD044873-DOD044983 Informal Investigation of Shooting Death of Obeed Hethere Radad (Iraqi National Detainee at Forward Operating Base Packhorse, Tikrit, Iraq) Under Auspices of AR 15-6 9/11/2003   Investigation into death of Obeed Hethere Radad. Detainee was in an isolation cell. The appointed guard saw the detainee touching the concertina wire, assumed he was trying to escape and fired his weapon, hitting the prisoner in the arm and chest, killing him. Detainee was handcuffed with plastic "flexicuffs" at the time he was shot. Accused guard stated that deceased detainee had been trying to talk to other detainee and fiddling with his handcuffs. "When I turned around the prisoner was standing past the doorway touching the wire. When I saw this it was apparent to me that the prisoner was trying to escape. I was across the room and I had no idea what devious intent the prisoner had . I raised my weapon and shot the prisoner." (DOD044907-8). Statement of another soldier who was on guard duty that night satates, "We were instructed the day before on the rules for the general population prisoners and the detainee in solitare which were if any of them try to escape shot them. The briefing was done by 1st Lt. [Redacted]. The two prisoners in solitare were instructed to face the wall sitting down, to not stand up without being told to and to not approach the wire or they would be shot." (DOD044927). Brother of deceased who was in cell next to him when shooting happened said in a sworn statement that the guard who shot his brother had been kicking the case and yelling and talking to him, but he could not understand and kicking the door, keeping them awake the whole night. (DOD044935). Medics had told guards that deceased detainee should be allowed to walk around his cell sometimes to relieve joint pain. (DOD044950-1). A soldier (PFC) states in sworn statement that they are "briefed to use minimal force as possible, but whatever the situation requires" and that while he doesn't know the accused soldier well, that the soldier "Yells a lot and has been warned for it. It wouldn't surprise me if he did other harmful things on his guard shift." Also states that "The guards from D..04ESB are too inexperienced to take on the responsibilities of EPW [Enemy Prisoner of War] guard. They seem a little hostile and confused about the consequences of some of their actions. Not all of them, just a couple . . They beat on the cages yell all the time and other small actions that are not needed all the time." (DOD044964-5. Action by appointing authority Raymond T. Odierno: "Bde [Brigade] Commander needs to ensure every leader is familiar with rights of detainees and discuss in general what is considered appropriate handling of detainees." (DOD044982).
DOD044984-DOD045029 Documents of AR 15-6 Investigation into abuse     Investigation into (1) whether SFC [Redacted] ordered soldiers to fire an MK-19 on unarmed civilians and whether civilians were wounded or killed in the incident; (2) whether members of BRT, 2nd Brigade placed detainees on top of a Humvee, between brushguard and hood during transportation to Brigade holding area; (3) whether members of BRT, 2d Brigade stole property from the homes of Iraqi citizens and the property of detainees. Findings: (1) allegation is unsubstantiated; (2) No proof that allegation is true; (3) uncorroborated. Soldier's statement says that on a mission, the platoon decided to set up an ambush and kill a civilian who had a weapon instead of driving up to him and taking the weapon, as has been standard practice for the platoon. The platoon waited until the civilian was next to the vehicle and opened fire. The civilian ran away and took cover in a field. "After the man ran into the field for cover we waitied close to a minute and there was never any fire returned. That's when my [Platoon Sergeant] told his gunner to spray the field with M-19 rounds... After the M-19 explosions all you heard was women and children screaming." The gunner said he saw no weapons in the house nearby. When a single shot cam from a distance of well over 500 meters away, the Platoon Sergeant said "F*** it, and light them up. His gunner shot about 304 M-19 rounds into the front yard and everyone else shot M-16s... 2 men were injured. One of them had his arm half blown off ... Finally a SUV drove by and loaded a bunch of injured people in it and drove off. And so did we looking for more people to kill. The R.O.E. [Rules of Engagement] for us over there was to engage and capture the enemy, seize all weapons, and give medical attention to anyone hurt. The R.O.E. was not followed because there were no ene[mies] or weapons." (DOD044988-90). Soldier recounts putting detainees on Humvees. "We would also take POWs and there wasn't anyone to come pick him up so we would put the POW on top of the HumV with the gunner until one tryed to throw up. After that we would hog tie them and stuff them in between the hood and the brush guard of the HumV. I asked at least tie his leg to the brush guard so he don't fall off and my NCO would say who cares, if he falls off we just ran him over and one less one to worry about." (DOD044991). DOD045030-045031     6/5/2002 An FBI agent observed improper tactics in the handling of a detainee in the interrogation room at Camp Delta. Saw detainee on his knees rubbing a cramp out of his leg while the DHS interrogator engaged him in questioning. The analyst in the observation room with the FBI agent was laughing. The FBI officer cautioned the analyst and interrogator on the fact that this conduct was inappropriate and could lead to a complaint from the Red Cross, at least. Another incident occurred in which the FBI agent observed a detainee bent over with his head on a table because he had been required to stand while still shacked to the deck. The author of the memo and the FBI agent both agreed tha this was a matter of education, training and closer supervision of interrogators. As a follow up, all the CITF and FBI agents were advised that detainees would not be caused to stand in the interview room.

Detainee said he was abused by Northern Alliance members after capture. Put into a truck and then into a ditch where he spent the night. Three days after his capture, he and others were made to jump into trucks. At one point they were made to get out of the truck where a "tall, caucasian looking man, who was wearing blue jeans" was taking pictures of the trucks and occupants. The detainees, about 100 of them, were then forced into what appears to be a metal shipping container with no windows and only small holes in the top for ventilation. The container was then closed. People inside began to scream and bang on the outside of the container, but no one opened it. The detainee blacked out from the lack of air and when he woke there were what appeared to be bullet holes on the wall of the container, he had a "grazing type wound" on his right elbow, and some detainees were dead. The detainees were in the container for about 24 hours with no air or water. The detainee believes that only about 20 detainees survived. The dead were put into a big hole and buried. He also heard that some of the men who were took weak to get out of the container on their own were also put into the hole. It seems the container traveled from Mazar-e-Sharif to Sabergaan jail.

DOD045198-045201 After Action Report (AAR) - Preliminary Investigation into the death of a Detainee at Geresch Forward Operating base, Helmand Province, Afghanistan     US personnel captured an Afghani male, 25-27 years of age on or about 11/04/03. When processed by USSF medical staff, he had several bruises to his hips, groin and buttocks area (some severe to minor) and numerous burns to his chest "(which is a known interview/interrogation 'technique' used by the local Afghanistan Militia Forces.)" On November 6, 2003, detainee was guarded by AMF security force at Geresch FOB with one other detainee. The AMF Security guard left the detainment area, and when he returned he discovered the detainee laying in a supine position, wrapped in a wool blanket in the center of the detainee area. It was determined that he was deceased. Interviews were conducted. A Staff Sergeant said it was not unusual to see detainees released to USSF with bruises to hips, groin and buttocks. The Staff Sergeant described these injuries as a "normal interview/interrogation method used by local AMF, that discovery was always determined by medical personnel and never reported by detainee... this was due to a cultural difference .. showing your buttocks to other pesonnel (especially males) was offensive and embarassing to the detainee, and was also considered a sign of weakness." A Sergeant First Class said he could provide photographs of prior detainees with similiar injuries when initially processed and photographed by the SF medics. Describes interrogation techniques: Does not use the "Safety Position" in the MI Booth; "Fear Up" includes disrespect for the Koran, throwing a chain inside the room; spotlights in a room; loud music; telling the detainee he's going to Guantanamo; raise the tone of voice of the interrogator or interpreter. This is all done under the supervision of the MP guard. Describes "giv[ing] light and sound for many days" and using females as an approach. "The process of interrogation is to degrade a PUC. We do not degrade a PUC for the sole purpose of degrading." States that in September 2003, instructors from Fort Huachuca went there to teach about interrogations. "Interrogations are professional and monitored. We have a problem that we are so restricted that we cannot use techniques to get intelligence from PUCs and that we are ineffective."

The majority of units stated that the law of land warfare training they received was classroom briefing and not hands-on training. Most of the combat arms units were unaware of the use of deadly force against an escaping prisoner. 2 of the 8 inspected facilities had chains to secure the prisoner, and a third unit admitted to chaining detainees to Hesco walls within the 550 cord."
