On September 26, 2006, the House of Representatives passed "The Public Expression of Religion Act" (PERA), by a vote of 244 to 173. The ACLU opposed this legislation because it would bar the recovery of attorneys' fees to citizens who win lawsuits asserting their fundamental constitutional and
civil rights in cases brought under the Establishment Clause of the First Amendment. The elimination of
attorneys' fees would create a system where only those that could afford expensive lawyers would be
able to access the courts when the government has acted unconstitutionally. Additionally, the ability to
recover attorneys' fees in civil rights and constitutional cases, including Establishment Clause cases, is
necessary to help protect the religious freedom of all Americans and to keep religion government-free.
