On December 16, 2005, the House of Representatives passed the Border Protection, Antiterrorism, and Illegal Immigration Control Act of 2005 by a vote of 239-182. This legislation would further militarize the border, allow low-level immigration officials to expel anyone found within 100 miles of the border believed to be a recently arrived undocumented immigrant without a hearing, expand mandatory detention of non-citizens who are not shown to be a danger or a flight risk and erode the right to judicial review. Further, it subjects all workers, including Americans, to verification of work eligibility through a government database riddled with errors that will result in workers temporarily being denied permission from the federal government to work at jobs for which they were hired. The ACLU opposed this measure because it harms civil liberties without resolving the difficult problem of illegal immigration.
